Terms of Service

These Terms govern your use of SyncYourMemory (the “Service”). SyncYourMemory is a registered business name of National Finance Options Pty Ltd (ABN 13 123 232 333), Melbourne, Australia, which is the contracting party (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The service
SyncYourMemory is a personal knowledge tool that stores your notes and uses AI features (chat, voice, transcription) to help you recall and connect them. Features may change over time.
2. Accounts
You are responsible for your account credentials and for activity under your account. You must provide accurate information and be old enough to form a binding contract in your jurisdiction.
3. Acceptable use
Do not use the Service unlawfully, infringe others’ rights, upload others’ personal data without a lawful basis, attempt to breach security, or abuse the AI/usage capacity (including automated flooding). We may suspend accounts that do.
4. Subscriptions, top-ups, billing, cancellation & refunds
Paid plans begin when you pay and do not include a free trial period — to try the product before paying, use the free plan, which has no time limit. Paid plans are billed in advance on a recurring basis via our payment processor (Stripe or PayPal). You can cancel anytime from Settings → billing (“Manage subscription”); cancellation takes effect at the end of the current paid period and your access continues until then. Annual subscriptions follow the same rule: cancel an annual subscription in its second month and you keep access for the remaining ten months, but those ten unused months are not refunded. An annual plan is a year paid in advance, so choose monthly if you are not sure you want the year. Except where required by law (including the Australian Consumer Law, which gives consumers non-excludable rights for major failures), payments already made are non-refundable and we do not refund partial/unused time. Prices and taxes are shown at checkout and may change with prior notice. To request a refund you believe is owed under law, contact us at support@syncyourmemory.com.
Prepaid top-ups (voice time). Buying voice time is a one-off prepaid purchase, not a subscription: it never renews, nothing recurs, and if you want more you buy it again. A top-up stays usable for 3 years from the date of purchase — the Australian Consumer Law requires at least three years for prepaid credit and voids any shorter expiry (ACL s99A), so this is not a period we can shorten. The balance does not reset monthly: whatever is unspent carries over, is added to the monthly allowance on your plan, and remains usable on the free plan. If a top-up payment is refunded in full or charged back, that pack's allowance is deducted from your balance (we do not bill you back for time already used), and any other pack you bought stays.
Chargebacks. If you raise a chargeback with your card issuer, it takes effect immediately, unlike an ordinary cancellation. Your account returns to the free plan at once, and any subscription still running is cancelled straight away rather than at the end of the paid period, so nothing is billed again. Any voice clone held at our voice provider is deleted (your enrolled samples stay in your account, so a clone can be recreated if you resubscribe), and if the disputed payment was a top-up, that pack's allowance is deducted from your balance. Your memories are not deleted. If something is wrong with a payment, please email support@syncyourmemory.com before disputing — it is usually faster, and it leaves your account intact.
5. AI output disclaimer
AI features can be inaccurate or incomplete. Output is provided “as is” and is not professional (legal, medical, financial) advice. Verify anything important before relying on it.
6. Your content
You retain ownership of the content you submit. You grant us the limited rights needed to operate the Service (store, process, and transmit your content to the subprocessors described in our Privacy Policy). You can export or delete your data at any time from Settings.
Voice cloning (optional) may be used only for your OWN voice and only with the explicit consent captured at recording. A separate "voice identities" feature lets you enrol voice samples of other people (e.g. family) — but only with that person's consent. Cloning or enrolling another person's voice without their authorization is prohibited and may result in suspension.
7. Termination
You may stop using the Service and delete your account anytime. We may suspend or terminate access for breach of these Terms or to comply with law.
8. Liability
To the extent permitted by law, the Service is provided “as is” and our aggregate liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits rights that cannot be excluded under the Australian Consumer Law.
9. Governing law
These Terms are governed by the laws of Victoria, Australia, and the courts there have exclusive jurisdiction, subject to any non-excludable consumer rights.
